What Is the AI Act and Why It Matters

The European AI Act is a regulation that controls how businesses can use artificial intelligence. It is not optional. If your SMB uses AI for anything—from website chatbots to automatic data analysis—you're subject to this law.

The New Deadline: August 2, 2026

From August 2 onwards, the AI Act requires immediate transparency. If you use AI for anything involving European citizens, you must inform them clearly and unambiguously.

Specifically:

  • ✅ If you have a chatbot on your website—you must inform the user they're talking to a machine
  • ✅ If you use AI to generate content (text, images)—you must indicate it was machine-generated
  • ✅ If you use AI in evaluation analyses (scoring or recommendations)—you must disclose this

This obligation applies to any interaction with European citizens. Even if you don't have European customers but serve Portuguese people online, you need to comply.

What's the Risk of Non-Compliance?

The fines are severe:

  • €15 million or 3% of worldwide annual revenue, whichever is higher
  • These fines apply even if you made no profit from selling AI
  • Enforcement has already begun and will intensify after August 2

This isn't a theoretical risk. It's an immediate risk. Companies are already being audited.

What You Need to Do Right Now

Don't wait until August 2. Start now:

1. Complete audit: Identify all ways you use AI in your SMB. Website? Analytics? Chatbots? Recommendations? Everything counts.

2. Check each tool: Ask your vendors (HubSpot, Shopify, marketing tools, etc.) if they use AI. If they do, request technical documentation of how they comply.

3. Implement disclosures: Add clear information at points of contact:

  • In chat: "You're speaking with an AI assistant"
  • In content: "This text was AI-generated"
  • In analyses: "This result was calculated by algorithm"

4. Document everything: Keep records of how you use AI, how you inform users, and how you comply. This is your protection.
