What Happened on August 2

Starting August 2, 2026, the European Union began enforcing transparency obligations under the AI Regulation (EU 2024/1689). This means if your company uses artificial intelligence in any form, you now have clear legal responsibilities.

This is not a distant warning or something you can postpone. The law is in effect, and penalties can reach €15 million or 3% of annual turnover (whichever is higher).

What does this mean in practice? If you have a chatbot on your website, create content with AI, use voice agents to handle customer calls, or any other AI application, you need to be compliant.

What Your Business Needs to Do Now

The EU has established four main categories where transparency is mandatory:

  1. Direct interaction with people - If a chatbot, voice assistant, or other system interacts directly with customers, they MUST know they're talking to AI, not a human.
  1. AI-generated content - If you publish social media posts, articles, images, or videos created with AI, you must clearly indicate it. This includes content altered or created by AI.
  1. Emotion recognition and biometric categorization - If you use AI to analyze facial expressions, voice tone, or biometric data, users must be informed.
  1. Deepfakes and public-interest content - Any video, audio, or image of people altered by AI must be clearly marked as such.

What this means for your business:

  • ✅ Audit: Identify all points where you use AI
  • ✅ Transparency: Add clear warnings to your systems
  • ✅ Marking: Use standardized icons or text for AI-generated content
  • ✅ Documentation: Keep compliance records
  • ✅ Training: Ensure your team understands the obligations

Practical Examples for Your Business

Scenario 1: Online store with chatbot If you have a chatbot that answers product questions, you're required to clearly show it's a bot, not a person. Examples: "You're chatting with an AI assistant" or an icon that indicates this at the start of the conversation.

Scenario 2: Social media posts with AI-generated content If you use ChatGPT, Claude, Gemini, or similar tools to create LinkedIn, Instagram, or Facebook posts, you must indicate that the content was created or altered with AI. This can be a simple note: "Created with AI assistance".

Scenario 3: Hospitality company with voice agent If you use a voice system to receive reservations or answer calls, customers must be informed from the start that they're speaking with an AI agent, not an employee.

Scenario 4: Agency with AI-generated images If you use tools like DALL-E, Midjourney, or Stable Diffusion to create images for campaigns, each image must have a clear mark that it was AI-generated.

The good news? The European Commission published a voluntary compliance code with standardized icons you can use. This makes compliance simpler and uniform.

Our Advice

Transparency about AI is not just a legal obligation—it's also an opportunity to build trust with your customers.

Most Portuguese consumers prefer companies that are honest about AI use. This changes the context: instead of hiding AI, you're showing that you're modern and efficient.

What to do now:

  1. This week: Audit all points where your company uses AI
  2. Next few weeks: Implement the necessary warnings and markings
  3. Before September: Ensure your entire team understands the obligations
  4. Document everything: Keep records of how you're compliant (this protects you in case of audit)
